Failure to include the certification in the order of commitment or the judgment of conviction shall not relieve a sex offender of the obligations imposed by this article. The remaining offender categories in this factor have no known relationship to recidivism. Some of these are included in the RAI, some are provided for as overrides, some are provided for by the instrument but in new york state board of sex offender examiners in Hayward modified form and some of the statutory factors are simply not included in the instrument.
The RAI considers not only the statistical risk that an offender will re-offend, but the harm which would be caused by a re-offense. The failure to accept responsibility is also scored under the RAI although it has no known direct relationship to re-offense risk.

The judicial hearings will be conducted in the county of conviction, unless otherwise provided in this Stipulation. Each of these risk factors is analyzed here. The Commentary indicates that this factor is intended to target offenders whose living or employment situation gives them ready access to victims. Courts are asked to consider whether such a factor is relevant in an individual case and if it is, consider a departure.
While the statute distinguishes these two Board functions, in practical terms, the RAI was developed by the Board and where the Board adopts the RAI score as its recommendation, the RAI and the Board recommendation are indistinguishable. Such listing shall be utilized for notification of such organizations in disseminating such information on level three sex offenders pursuant to this paragraph.
